MODLAN INTELLIGENCE RESOURCE · GUIDE
Social Media Evidence Authentication: From Public Content to Evidentiary Record
How lawful public-source content can be documented, acquired, hashed, attributed, preserved, and explained without overstating what any one control proves.
Discovery is not authentication
Locating a public post answers where information was found. Authentication requires a separate record of acquisition method, source context, timing, integrity, examiner activity, and the limits of what the capture establishes.
Capture process and authorship are different questions
A documented acquisition can support the accuracy of a captured record without proving who authored the underlying content. MODLAN treats attribution as a separate investigative analysis rather than hiding that uncertainty inside the capture certificate.
Integrity begins at acquisition
Cryptographic digests, source-path documentation, examiner identity, timestamps, native preservation, and custody records help later reviewers determine whether the preserved collection is the same collection that was acquired.
A witness still matters
Technical records are strongest when the person who performed the work can explain the method, limitations, attribution analysis, and chain of custody under review, declaration, deposition, or testimony where appropriate.
