MODLAN STANDARDS

How we work

These apply to every engagement, in every jurisdiction.

  • Recorded consent, everywhereWe obtain recorded consent from every party to every recorded statement, in every jurisdiction, regardless of which state rule applies.
  • Lawful vantageObservation is conducted from publicly accessible vantage points. We do not enter private property, observe into areas where privacy is reasonably expected, or place concealed or unattended recording devices.
  • No pretextInvestigators identify themselves where identification is appropriate. We do not use fictitious identities, misrepresent our purpose, or obtain information under false pretences.
  • Documented permissible useInformation from restricted sources is accessed only for the permitted purpose of the matter it was obtained for, and that purpose is documented for every search.
  • Represented partiesWhere a party is represented, we proceed only on documented instruction from counsel.
  • Aerial for property, not peopleAerial documentation is used for property, scene, and loss documentation. We do not use aircraft to observe individuals.
  • Public sources, unauthenticatedDigital collection is performed from publicly accessible sources without logging in to any account.

YOUR GUIDELINESScope, coverage, reporting format, documentation requirements, and turnaround are performed to your guidelines and the assignment instructions for each matter. Requirements differ by carrier and by jurisdiction, and we work to yours.

AUTHORITY + MINIMUM NECESSARY

The authorization is the first investigative control.

Privacy law governs whether a provider may answer, not whether an investigator may ask. We build on the second question, because that is where the exposure actually lands.

AUTHORITY

Validate before contact

Provider contact occurs only on a current, unexpired, claimant-signed authorization that names MODLAN as a recipient and is limited to the existence and dates of treatment.

SCOPE

Existence + dates only

The canvass is intentionally narrower than a medical-record request and is never a substitute for one.

INDETERMINATE

Unknown stays unknown

Facility categories whose records carry heightened statutory protection are excluded from canvass by design, not by investigator discretion. Where a facility type is excluded or indeterminate, the result is reported as not determinable — never as an absence of treatment.

REPORT

Lead, not coverage conclusion

A canvass result is reported as a source lead for appropriately authorized follow-up.

WHAT WE DO NOT DO

  • Contact a provider without validated written authority.
  • Collect clinical detail beyond the authorized narrow scope.
  • Report an excluded, refused, or indeterminate provider response as no treatment.
  • Bundle consumer-report identity data into the canvass product.
  • Obtain information under a false identity or false pretences.
  • Enter private property or observe into areas where privacy is reasonably expected.
  • Contact a represented party except on documented instruction from counsel.
  • Guarantee that any item will be admitted by a court.

QUESTIONS

Common questions

Can this be performed without an authorization?

No. MODLAN's service architecture requires a current, validated authorization before provider contact.

Do you collect diagnosis or medication information?

No. This canvass is intentionally limited to treatment existence and dates. Volunteered clinical detail is not incorporated into the canvass record.

What if a provider refuses to answer?

The refusal is recorded as a valid outcome. It is not scored as investigator failure and it is not reported as no treatment.

Is a canvass result the same as a medical record?

No. The canvass is a lead for an appropriately authorized records request, not a substitute for the record itself.
